Cross Border Data Privacy: EU-US Safe Harbor and Beyond

Frances Henderson, the National Director of Privacy Initiatives at the Council of Better Business Bureaus will discuss the EU-US Safe Harbor, the effects of the post-Snowden negotiations between the EU Commission and the US on the Safe Harbor, and how the APEC Cross Border Privacy compares to EU Safe Harbor. Frances is National Director, Privacy Initiatives at the Council of Better Business Bureaus (CBBB), the umbrella organization for the BBB system. Since 2008, she has directed the Council’s BBB EU Safe Harbor program, an independent dispute resolution mechanism for privacy complaints involving transfers of personal data from the European Union and Switzerland to companies in the United States. Representing the CBBB on the United States delegation to APEC’s Data Privacy Subgroup, Frances has actively participated in the development of the Cross Border Privacy Rules System endorsed by the APEC economies in 2011. She also advises the CBBB on national and international consumer privacy issues, including internet privacy, online behavioral advertising, and online dispute resolution. Before joining the CBBB, Frances headed the international trade practice at the law firm Sonnenschein, Nath & Rosenthal (now known as Dentons), where she counseled clients on international trade law and policy, corporate compliance, and national security issues. She is a former Lecturer in Public Law at the University of Aberdeen, Scotland. She received her LL.B with Honors from the University of Glasgow, Scotland, an LL.M from the University of Virginia Law School, and a J.D. from the University of Minnesota Law School. She is also a Certified Information Privacy Professional.
